When you enter into a contractual agreement with a lender, you are telling that lender that you will take responsibility for paying back that loan, even if the other borrower files bankruptcy or you experience a divorce. This agreement includes everyone who has signed the contract and holds everyone to the same standard. Removing your name from any debt is not an easy process, but is it possible to remove your name from a title loan?

Some types of debt can be transferred with cosigner release programs or refinancing. But unlike mortgage or auto loans, title loan lenders typically do not offer these types of programs. It is not likely that you will be able to remove your name from this type of debt, so be prepared to continue to make payments until the balance is paid off.

Some Options

However, there are some options available to you if have possession of your vehicle. If you have a title loan, it is likely that your vehicle is paid off, or is close to being paid off. If you are able to refinance your car, you can do so and use the funds to pay off the title loan debt. This will clear out what you owe to the title loan lender, but understand that you will now have a new debt for the vehicle. Additionally, you can sell the vehicle and use the funds to pay off your debt. Just be sure to honor any agreements set forth in your divorce decree, to avoid any unnecessary legal snafus.

Prior to agreeing to cosign a loan together, it is always a good idea to have a discussion with your spouse about the expectations of paying off that debt. Additionally, ask your lender prior to signing your contract what your options are if your situation changes. We all go into certain circumstances with the expectation that things are not going to change, but borrowing smartly means that you are willing to look into all potential outcomes. Having a solid backup plan in case things change is a good idea, to protect everyone involved.
